By accessing or using FishFyndr (“the Service”, “we”, “us”, or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to all the Terms, do not use FishFyndr.

2. Service Overview

FishFyndr provides real estate analytics, rental estimates, property data, and AI-assisted information for research and informational purposes only. No content or feature on FishFyndr constitutes financial, investment, legal, or tax advice.

3. Eligibility & Accounts

  • You must be at least 18 years old and able to form a binding contract in your jurisdiction to use FishFyndr.
  • You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

4. User Conduct

  • Do not use FishFyndr for any unlawful, abusive, or fraudulent purpose.
  • You may not copy, resell, or commercially exploit any portion of the Service without our written consent.
  • You agree not to attempt to access data, accounts, or systems for which you do not have authorization.

5. Data & Content

  • FishFyndr aggregates property and rental data from third-party providers. We do not guarantee the accuracy, completeness, or timeliness of this data.
  • All information is provided “as is” for informational purposes. You are solely responsible for verifying the information before making decisions based on it.
  • We may update or discontinue any part of the Service at any time.

6. Privacy

  • Your use of FishFyndr is also governed by our Privacy Policy.
  • We use industry-standard measures to protect your information, but cannot guarantee absolute security.

7. AI Disclaimer

  • AI-generated answers and analytics provided by FishFyndr’s Assistant are for informational purposes only and may contain errors or outdated information.
  • Always consult with a qualified professional before relying on any AI-provided output.

8. Limitation of Liability

  • To the fullest extent allowed by law, FishFyndr and its affiliates will not be liable for any direct, indirect, incidental, special, or consequential damages resulting from your use of the Service.
  • Our maximum liability to any user will not exceed the amount paid (if any) to use FishFyndr in the preceding 12 months.

9. Indemnification

You agree to indemnify and hold harmless FishFyndr, its owners, partners, and employees from any claims, damages, or expenses arising out of your use of the Service or violation of these Terms.

10. Changes to Terms

We may update these Terms from time to time. Continued use of the Service constitutes your acceptance of the revised Terms. We will post the most current version on this page.

11. Billing and Payment

  • Subscription Fees: You agree to pay all applicable fees based on your selected subscription plan or service tier. All fees are charged in U.S. dollars and are non-refundable except as described below.
  • Payment Responsibility: You are responsible for maintaining valid and up-to-date payment information. Failed or declined payments may result in immediate suspension or termination of your access to FishFyndr.
  • Refund Policy: We do not offer automatic refunds. However, if you believe you were charged in error or experienced service issues, you may contact us within 7 days of the charge to request a partial refund. Any refund granted will be at our sole discretion and may be prorated based on your account activity and usage. Frequent or significant usage of FishFyndr’s tools or downloads may disqualify a refund request.
  • Chargeback Policy: Initiating a chargeback without first contacting us to resolve the issue may be considered a violation of these Terms. We reserve the right to:
    • Immediately suspend or terminate your access to the Service
    • Dispute the chargeback with appropriate evidence
    • Report the incident to relevant payment processors or fraud databases
  • Plan Changes: If you choose to upgrade your subscription plan, the change will take effect immediately and your fee will be prorated based on the remaining time in your current billing cycle. If you choose to downgrade, the change will take effect at the start of the next billing cycle, and no partial refunds will be issued.
  • Billing Changes: We may modify our pricing, billing cycles, or plan features at any time. Such changes will apply to future billing cycles, and we will make reasonable efforts to notify you in advance.
  • Third-Party Processors: FishFyndr uses third-party payment processors to securely manage transactions. Your payment and billing information is subject to their terms and privacy policies.

12. Termination

We reserve the right to suspend or terminate your access to FishFyndr at our discretion, without notice, for conduct that violates these Terms, failure to pay applicable fees, or for behavior deemed harmful to other users or to FishFyndr.

13. Governing Law

These Terms are governed by the laws of the State of Maryland, USA, without regard to its conflict of law provisions.
